Vibrate

Terms of Service

Vibrate is made by Wonderland Software LLC ("Wonderland Software," "we," or "us"), based in Austin, Texas. These terms are an agreement between you and Wonderland Software. They cover the Vibrate app and this website. If you use either one, you agree to these terms.

Who can use Vibrate

You must be at least 13. If the law where you live sets a higher age, you must meet that age. You may not use Vibrate if we have closed your account, or if the law stops you from using it.

Accounts

A phone number signs you in. You are responsible for what happens on your account, and for keeping that phone in your control. Use a number you have the right to use. We may refuse a number, or close an account, if we believe it breaks these terms or puts other people at risk.

The beta

The app is pre-release software. Expect rough edges, changes, and lost posts. When a build is delivered through Apple TestFlight, Apple's terms apply to that delivery.

Your posts

You keep ownership of the photos, captions, ratings, comments, and other material you submit. You give us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify for display, and show that material so Vibrate can run. The license lets our service providers do those same things for us. It also lets us use a public post to explain or promote Vibrate.

The license ends when you delete the material or your account, except for copies we need for backups, legal duties, security, or disputes, and except for material other people have already received. We do not have to keep or display anything you submit. Posts can leave the map and the main feed after a short time and can remain on a profile until you or we delete them.

You promise that you have the rights to what you post, that it does not break the law or anyone else's rights, and that a place you pin is a place you choose to share. A pinned place may include precise location shared with friends. Do not pin a private home, workplace, or any place you are not willing to share.

Public vibes. If you share a vibe with everyone, it is public. Anyone can view it on the web at its link without an account, and anyone can share it. Other apps, sites, and search engines may show previews or copies of it. You are responsible for what you post publicly. If you delete a public vibe, we stop showing it at its link, but previews and copies that others already made may remain for a period of time, outside our control.

What you may not do

Do not post anything illegal, or anything that sexually exploits a minor. Do not threaten, harass, or impersonate anyone. Do not post someone else's private information, or material you do not have the right to share. Do not spam, scrape, probe, or interfere with the service, and do not try to get into an account that is not yours.

If you believe something on Vibrate infringes your copyright, email tag@vibrate.world with the work, the location of the material, your contact details, and a statement that you are the owner or the owner's agent. We may remove the material.

Reports and blocks

You can report a person, a post, or a comment in the app. We may review reports and remove material or restrict accounts. We may also check photos automatically when they are posted, and we may hide or remove a post based on those checks. If you think a post was removed by mistake, email tag@vibrate.world and we will review it. You can block someone so they no longer appear to you and so certain interactions stop both ways. Abuse of reporting or blocking (including false reports meant to harass) can lead to account action.

Other people

Other people post their own material. We do not promise that it is true, safe, or lawful. A place on a post is chosen by the person who posted it. We may review, remove, or refuse material, and we may do that without notice.

Apple

If you got the app from Apple, these terms are between you and Wonderland Software, not Apple. Apple is not responsible for the app, for maintenance, or for claims about it, including product claims, consumer claims, and intellectual-property claims. If the app fails to meet a warranty, you may notify Apple, and Apple may refund the purchase price if there was one. Apple has no other warranty duty. Apple and its companies are third-party beneficiaries of this section and can enforce it.

No warranty

Vibrate is provided as is and as available. We disclaim warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty that the service will be uninterrupted, accurate, or secure. Some places do not allow these disclaimers. In those places, they apply only as far as the law allows.

Limits on liability

To the fullest extent the law allows, Wonderland Software and its people are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill. Our total liability for any claim about Vibrate is limited to the greater of one hundred dollars or the amount you paid us for Vibrate in the twelve months before the claim.

These limits do not apply to liability that the law does not let us limit, including fraud, willful misconduct, or death or personal injury caused by negligence where a limit is forbidden.

Your responsibility for claims

If someone brings a claim against us because of your posts, your account, or your misuse of Vibrate, you will indemnify us. That means you will pay the damages, settlements, and reasonable legal costs that result. This does not apply to the extent we caused the claim by willful misconduct.

Closing an account

You can delete your account in the app. We can suspend or close an account, or stop the service, at any time. Sections that should survive will survive, including your promises, the content license for material we may still hold, warranty disclaimers, liability limits, indemnity, and disputes.

Disputes

Texas law governs these terms, except its conflict-of-law rules. Before you file a claim, email us and give us 30 days to try to resolve it.

Except for a claim that qualifies for small claims court, or a request for an injunction to protect intellectual property, any dispute will be resolved by binding individual arbitration under the Consumer Arbitration Rules of the American Arbitration Association. The arbitration will be in Austin, Texas, or by video if the rules allow. You and we waive a jury trial and waive any right to bring or join a class, collective, or representative action.

You may opt out of arbitration within 30 days of first accepting these terms by emailing tag@vibrate.world with the subject "Arbitration opt-out" and your phone number. If you opt out, or if this arbitration section is found unenforceable, the state and federal courts in Travis County, Texas are the exclusive venue, and both sides consent to those courts.

Changes

We may update these terms. The date at the top of this page will change when we do. If you keep using Vibrate after the update, the new terms apply. If you do not agree, stop using Vibrate and delete your account.
